IS MY JOURNAL “PUBLIC?”

Yes. And no. As an appointed public official, every notarial act you perform is subject to scrutiny.

However…………

Your notary journal is not for any member of the public to just “take a look.” If there is a specific reason that someone needs to verify an entry in your notary journal, please ask that they submit their request in writing. This is so important because it covers you should that persons intentions are called into question. In addition, always be sure that ONLY the line item in question is visible by using a notary journal guard.

And, last but not least, NEVER allow someone to copy a page from your journal – this includes using any type of camera to take a picture.

It is not commonplace, but notaries sometimes are asked to testify in court as to the validity of a notarization.

I have been doing this for some time and I approach every signing as if it is the first. Slow down. Follow the proven steps. And review the documents carefully before you seal it.
